Arthur Stuart Astle, of unlaw fully soliciting orders for liquor within ihe no-license area ol Alastcrton. by advertising that the Wairarupa Fanners’ Co-operative As-ociation, of which appellant was the Creytown malinger, was prepared in take orders for Christmas hampers of -pirituyus liquors. H. C. Robinson, Alaslerton, appeared for the appellant, and the Solicitor General, AI- MacGregor. K.C., for the re.-]ajndent. Afr Robinson contended that it was la wild to solicit order- m a no-hcetisc di-t lief for a lawful order, lie pointed out that probably every newspaper circulating in the iio-liccnse area bad liquor advertisements therein. lie contended lurthor, that (lie adveitisomeni was not .soliciting, inasmuch as there was no element of persuasion in it.
The Solicitor-General contended that - Hu* applicant came within the very word- of the law in that he did solicit ior an order for liquor within the Afas- ■ terton district and it was difficult to : conceive a stronger solicitation than an advertisement in a local paper.
