APPEAL UPHELD

(BY TELEGRAPH PEESS ASSOCIATION.) WELLINGTON, July 18. One, Dolling, a tobacconist of Petone, was convicted under the Gaming Act oi' using premises in his occupation as a gaming house, and appealed to Judge ISalmond, who upheld tue appeal on tne ground that there was no evidence of bets with any other person than a constable who sought defendant out and made a bet with him on two occasions. The judge held that the prosecution could not by proving one or two bets with a single individual call, v.pon the' defendant to rebut a mere "suspicion that, those bets might in truth have been episodes in the conduct of an established betting business conducted upon the premises in violation of the Act.
