The reserved decision of Mr. Justice Chapman in the appeal from the Magistrate's Court in the case of Fever v. Booker was delivered in the Supreme Court, New Plymouth, this morning, j The claim, one for damages in respect ' of a motor collision, was originally heard before Mr. T. A. B. Bailey, S.M.,' in the Magistrate's Court, Eitham, ! when judgment was given in favour ■ of the defendant, Booker. | From this decision the plaintiff, Fever, appealed, and, after hearing the appeal, the Supreme Court ordered the case back to the Magistrate's Court for a new hearing. On the new hearing Mr. Bailey, S.M., again found in favour of the defendant, Booker. From this decision the plaintiff again appealed to the Supreme Court, which now allowed the appeal, and judgment is given in favour of plaintiff, Fever, for £137 7s 9d provisionally and costs, and co.sbs on both hearings in the Magistrate's Court and in the prior hearing in the Supreme Court. in all the various hearings Mr. P. . O'Den apppared for the plaintiff and Mr. R. IT. Quilliam for the defendant,
