BREACH OF LICENSING ACT

(BT TELEGRAPH —PRESS ASSOCIATION.) CARTERTON, Sept. 8. In the Magistrate's Court at Carterton yesterday W. J. Condor, licensee of the Royal Oak Hotel, Carterton, was charged: with a breach of the Licensing Act, in that he sold draught whisky m a bottle bearing: the name of a wellknown brand of liouor.
The case for the prosecution was that some men, visited the hotel and purchased two bottles of draught whisky, and defendant filled an empty whisky bottle without" defacing the label. - It was admitted by the ,prosecution that the purchasers" were ay are that they were fretting draught whisky and paid the usual nrice for this rnahty The offence, however, was having bottles intended for use wrongly labelled. The magistrate, in imposing a fine of £20 and costs, pointed out that his hands were tied b y the Act, which provided for a minimum nenalty of £20, and a maximum of £200. the, Act looked upon the offence as a serious I one, but in view of the circumstances |:t was open to the defendant to apply for a remission of a portion of the fine, and he would recommend same.
