CLERK MAKES APPLICATION TO SUPREME COURT.

Application was-.made at the Supreme Court to-day, 'before the Chief Justice (Sir Robert Stout), /by Percy Reginald Sutherland, clerk in the General Post Office, against Mr A. C. Cutten, chairman of the Appeal Board, for a writ of mandamus regarding the right of appeal. The application was made to test an interpretation, given by the Departmental Appeal Board to certain clauses of the Post and; Telegraph Amendment Act, 1911/ in the case of junior officers. Sutherland claimed,that he had not been given that increment to which he was entitled on his reports as to /merit and efficiency. The case was referred to the Appeal 'Board, -which stated that there was no right to appeal under such circumstances. The. Court was to-day I asked to decide whether that ruling or interpretation Avas correct or not. Mr Myers appeared for appellant -and. Mr Skerret* for defendant. The case is j proceeding.
