MAGISTRATE'S COURT

A sitting of the Magistrate's Court was held at Eltham on Wednesday- before Mr T. A. B- Bailey, S.M. , . Judgment by default was given, in the following' civil cases: G. W. E. Brodger v. F. W. Ga,Trett £55 15s 3 costs £5 6s 6d; Albert Beesley v. Walter J. JLiehtwark, 14«, costs Bs.

Inja judgment summons case against Benjamin George Hart, for £8 19s 6d, the Magistrate, after examining the judgment debtor, refused to make an order. The plaintiff was Mrs M. J. Anderson. '

On a judgment summons, Thomas, Oliver and Thomas (Mr Chrysfcal) v. Xewis Benjamin Parsons, an order was made for the payment or £18 ss' 3d .forthwith, in' default eighteen days' imprisonment. • The same plaintiffs proceeded against <3eorge Dames on an order for payment of £33 15s- 7d. The case was adjourned until January 25 in order to allow of debtor's statement regarding his wages being verified. Margaret Brew (Mr T. B. Crump) -applied for an ordei; for the payment -of .arrears of maintenance by Dennis Brew, her husband, against whom she recently obtained a separation order. The arrears were £12 to October 18. "The Magistrate convicted Brew and sentenced him to one month's imprisonment.

In - the case Lister v. Schneller, ■which was -a claim of £140 for damage to a paddock of* turnips, etc., brought by fm, George Lister (Mr Beechey) against Robert Schneller (Mr L. Moss), further evidence was. given.- The Magistrate said he would give his judgment in writing. ■ Two youths, Kenneth Cruden- and John Ottaway. were charged on the information of the Hawera Acclimatisation Society, with fishing in the Waingongoro river without a license, and both pleaded guilty. Mr A. A. Stew--art, who appeared for the Acclimatisation Society, said he was instructed not to press for a heavy penalty. The Magistrate remarked that that was jprobably not the only time they naa been fishing, and no doubt upon other -occasions they had been more fortunate. Accused would each be fined 10s, with 7s costs and 10s 6d solicitor's fee.—Abridged from Argus.
