At the Supreme Court at New Plymouth on Thursday, before Mr Justice Edwards, a claim was made by Hamilton Gilmour and the Public Trustee (as executor for Allan McGuire) against Laura Berry for a three-fourths share of the estate of Allan McGuire. The defendant was not represented. Sir John Findlay, for the plaintiffs, said" the defendant's husband had been in partnership with Gilmour and McGuire as ironmongers at New Plymouth. Berry held a three-fourths share in the business, and the others one-eighth share each. At the death of McGuire the business was placed in .he hands of a receiver to ascertain the value of MeGuire's estate fior probate. During the repeivef's investigations he discovered that Berry had assigned, without the knowledge of his partners, his three-fourths interest in the freehold property of the business, which was calculated in the assets of the business, to his wife. His Honor gave judgment declaring that the freehold property was part of the assets of the partnership, and that the defendant was a trustee of the threefourths share registered in her name. Further consideration was reserved, with liberty for either party to apply.
