POSITION OF THE COURTS.
PRETORIA, Jan. 29. When Lucas' counsel applied for an order restraining the Government, Mr Justice. Wessels bleclared he could not assume upon rumors that the Government was going to kidnap citizens and deport them, "except by Act of "Parliament, Mr Justice Mason remarked that he must not be taken as concurring that the material before the court was insufficient- He' called the Attorneygeneral, who declared he was unaware of the facts. Truter, replying to Judge Mason, stated he had handed the prisoners to the escort under the Government's instructions. Lucas' application for an attachment order wa*s based on the fact that Poutsama and Waterston should have appeared before the court -on Wednesday morning. An application that Smith be ordered to produce the deporteds was I withdrawn, on the ground that the ! court had no jurisdiction beyond the Transvaal.
