ABOUT A PROMISSORY NOTE.

WELLINGTON, May 15. Tasman John Chamberlain Gurr was charged at the Magistrate's Court today, on the information of Robert Cooper, with having fraudulently converted to his own use £100 (the amount of a promissory note). Mr Treadwell for the informant, asked that the Magistrate (Mr W. G. Riddell, S.M.) should allow the information to be withdrawn. He did this because he thought no jury would convict. His Worship declined to accede to the request without calling certain evidence. From this it appeared that Cooper was Gurr's agent in Wanganui, and Cooper had given Gurr a promissory note for £100 as a justification of his bona fides, the promissory note to be used for no other purpose. Subsequently the promissory note was paid into the Union Bank of Australia by Gurr as a security against an overdraft. Cooner. confessed judgment when sued by the bank for the amount of the note,but- Gurr had not yet paid up. After hearing these and other statements, the Magistrate allowed the information to be withdrawn.
