MAGISTRATE'S COURT.
ALLEGED BREACH OF MILKING
AGREEMENT.
After the Star went to press on Tuesday further evidence for the plaintiff, in the case- of T. H. McDonald v. B. Duffell, a claim for £155 arising out of an alleged breach of a milking agreement, was taken. W. W. Davy, motor engineer in the employ of G. F. Hutchinson, who also inspected some of the plant, said the engine was in good Tunning order and nothing needed to he renewed. - John 0. Jones, farmer, said he had seen the calves belonging to defendant and he consdered the majority of them were about the average, a little on the small side. This would be due principally to the breted —cross Ayrshire. Taking into consideration the weather, the percentage of deaths would be 15 per cent. The cows were a fair average herd. Witness did not think the animals had been ill-treated and appeared to be thriving well. Witness admitted that the calves micrht have been a little better. j Evidence as to the satisfactory condition of the stock was given by A. A. Churchill. Michael Murray, who was employed by the plaintiff, said the cows were always milked proparly and that the cows and heifer were well looked after. When he first went there there were some slight marks on the legs of the cows, due to the leg rope. Neither witness nor himself had ever watered the milk. Witness vaiued the garden produce belonging to plaintiff at £2. The engine on the morning plaintiff was dismissed worked satisfactorily. There were no complaints made by the factory manager to witness as to the milk having been watered. | Cross-examined, witness stated that ! on two occasions defendant had had to send for his son to attend to the engine. To Mr ODea: It was after the engine had bean changed that defendant had to send for his son. This concluded the case for the plaintiff, and the further hearing was adjourned until next Tuesday.
