AFFECTING THE NODINE CASE

When the- Judicature Amendment Bill was before the Legislative Council on Thursday afternoon several members raised strong objection to one of its clauses— that empowering the Supreme Court to order the execution of " lease or similar document on behalf of a defendant who refuses to do so himself — being made retrospective in action. The clause was inserted to meet such cases as that of Mr Nodine, but members declared that there should bo ' no possibility of interference with thf>+. particular piece of litigation. The Bill was returned to the Council by tht» Statutes Revision Committee, when it was found that the following proviso, had been put in :"The section shall no* affect any action or other proceeding already commenced in any Court pr invalidate anything heretofore lawful^* done, or validate anything already declared to be invalid in any proceeding in any Court."
