PRIVY COUNCIL.
LONDON, March 20, In the case Hamilton Gas Company v. Parker, the appeal was allowed with costs. • [The cause of the action was the proposal to take over the gas supply by theL borough. In the first case the matter of price was referred to arbitrators, but, as they failed to come to an agreement, the case was sent to the umpire. In the Act empowering the company to establish works a clause was inserted, providing that at the end of twelve years the borough could, if it was deemed advisable, take over the gas supply upon payment of the then full value of the concern, and m the event of interest not havrog been earned, amounting to 10 per cent, per annum for the whole period, the Council was to make it up to that sum. The Gas Company, however, claimed for commercial value, or, in other words, goodwill. The umpire decided that the company was not entitled to any goodwill, because of the proviso regarding the making up of the interest to 10 per cent, by the' Council" in the event of the amount not having 1 been earned. The case went the round of the Courts until it reached the Privy Council, and as the Gas Company were the appellants, it would seem that their contention has been upheld.]
