WELLINGTON, December 3. The Appeal Court to-day gave judgment in the case Rex. v. McCann and Brown. The point was whether a Judge could comment on the refusal of a prisoner to give evidence in his own defence. Separate judgments were delivered by each of the five Judges who heard the case, Justices Williams, Denniston and Cooper holding that a Judge could not comment, and Justices Edwards and Chapman dissenting. The conviction was, therefore, quashed by the majority. The Court adjourned till February 1.
