WELLINGTON, October 15

The Court of Appeal to-day began the hearing of in re Moore (deceased) and Townsend v. Commissioner of Stamps. The appellant is Annie Quayle Townsend, daughter of Henry Moore, deceased, and co-executor with two executors. Under his will testator, who died at Christchurch on July 7, 1905, in his 93rd 'year, left all his property to his daughter. His estate in New Zealand was certified by respondent to be of the value of £686,158, on which duty of £34,307 was claimed. The executors declined to pay, claiming the value was £253,936, and the balance, '£432,222, was the absolute property of the appellant, having come into her possession before her father's death. Respondent denied this, and claimed alternatively that it was put into appellant's name to evade duty, or that it can^e into her nands as a deed of gift, and was therefore liable to duty. The Minister for Stamps petitioned for leave to examine appellant as to how she became possessed of these moneys.

The whble case was moved into the Court of Appeal' for argument. Mr Skerrett, K.C., and Mr Brown, of Christchurch, are for the appellant, and Mr Stringer, K.C., and Mr Myers for the respondent.

Steward, waited on the Minister for Lands to-day with, the re■quest that the Land Bill should be amended in the direction of freeing 'Crown tenants from the operation of the cropping regulations where they put 50 per cent of improvements on their holdings. The MinasteT, in reply, said the proposals of the Bill when in committee had been enormously modified in the 'direction referred to by the deputation.
