WANGANUI, December 15. At the Magistrate's Court to-day a test case is being heard with 1 a view to obtaining a judicial definition of clause 42 of the Licensing Act, 1904. The licensee (G. Brown) of the Caitlecliff Hotel, is charged with selling liquor to James Palmer on Sunday last, the latter not being a lodger. The facto were admitted, namely, that Palmer who it Chairman of the Wangaui Licensed Victuallers' Association went fof-an outing to Castlecliff, and having^ previously informed the police that he intended to do so, asked as a bona fide traveller for liquor in the presence of the. police. • .A drink, was supplied, hence a friendly. Action to define the position. December 15. . Dr McArthur, S.M., delivered his re«erved judgment in several cases under the new Licensing Act. In two cases, otic of being on premises after closing time, the other of being served tea on Sunday afternoon, he dismissed the information as it was not shown that the defendants were on the premises in contravention of' the Act. In a third case in which defendant pleaded that he was on premises on Sunday to secure a meal his Worship imposed a small fine as he discredited the excuse offered.
