HAWERA RESIDENT MAGISTRATE'S COURT.
Tuesday, 11th Julx.
(Before Captain Wilson and F. McGuire, Esq., J.P.s). STEALING EROM A DWELLING.
W. R. Rose, charged with stealing £8, the property of James Clarke, at Manaia, on the 27 th June.
•James Clarke, milkman, gave evidence — On the 30th, I missed £Q, which was taken out of a leather bag, from a whare, close to the A.C. camp. I could identify one note only, which had a piece of paper pasted on. Mr. NicolPs man believed he had changed such a note on the 26th June. Prisoner told me he had only 10s. 6d. The cook of the sergeant's m- ss would be able to see any one going into the whare.
To the prisoner — You had seen me unlock the bag to take money out of it on another occasion.
Henry Gapper, shopman, Manaia, deposed that on the 27th June, prisoner bought a coat at the store, and tendered two £1 notes. The coat cost 30s. One of the notes had a piece of paper pasted across the back of it. The description of the note tallies with the one given by the prisoner. I had no reason to suspect that the notes were stolen.
J. Donovan, A.C., deposed — I am cook of the sergeant's mess, Manaia. On the 27th June, I saw the prisoner enter Clarke's whare. He stayed there some time ; if he bad left immediately, I should have seen him. I had seen him at Clarke's whare previous to this.
Wm. Campbell, canteen-keeper — I gave prisoner £2 19s. or £3 when I settled with him in May. I know he borrowed a pound from Mr. Sutton on my account in May, and I spoke about it on the Bth or 9fch of June.
By the prisoner — I believe you earned money at your profession, in addition to yonr regular pay of 80s. a week which
you received from me, while in my employ. T. .Lloyd, hotelkeeper, deposed— l gave 15s. to prisoner about the end of June. As a rule, he always paid for whatever he got from me. Sergeant Cahill gave evidence— l arrested the prisoner on the 2nd July, at Otakeho. Prisoner stated first that he went for milk, and then that he went to the whare to pay Clarke ss. on the 27th June. Prisoner told me he had spent all his money at Hawera and Cpunake. The prisoner was then duly committed for trial at New Plymouth.
