A carious action has been tried in America. A child was playing by tin; side of a railro id. An express came past, whirled it on this lines, and killed it; whereupon the parents sued the railway company for damages, on the ground that the train carried ;in unmuzzled air vacuum in its wake, which ought to be controlled. The company denied the vacuum, and Professor Francis E. Nipher was appointed as expert to decide the question. He made experiments on the company's )ine3, and found that while it was true that there was no vacuum, yet there was violent displacement of the layers of air nearest tho Hying train, which imparted a rotary motion to all bodies with which they came in contact. Tho company tias, therefore, held to account for not properly controlling the layers of air.
