UNDER TWO AWARDS.
COURT’S IMPORTANT DECISION. (By Telegraph —Press Association.) WELLINGTON, July 10. An important reserved decision defining the position of an employee whodoes work which may come within two, different awards was given by Mr. J. TT. Luxford, S.M., in the Magistrate’s Court. Mr. Luxford allowed a penalty of on each of three claims made by the Labour Department against Messrs Smith and Smith, Ltd., the department alleging that three employees had been paid retail employees’ wages, whereas they were substantially doing wholesale Or warehousemen’s work. The Magistrate held that the employer was bound to pay award wages to every employee who was a worker in two or more industries ench covered bj an award. He was to be paid the rate prescribed for the industry in which he. was engaged for the major portion )f his time, but, if only one of the industries was covered by the award, he was entitled to the rate prescribed by thataward.
