COMPLICATED LAND DEAL
CLAIM FOR SPECIFIC PERFORMANCE. WELLINGTON, Last Night. Judgment was given by His Honour Mr. Justice McGregor, in the Supreme Court today, in a case in which C. H. G. Bennett proceeded against J. C. Grensill, sheep farmer, for specificperformance of agreement for sale by defendant of his property at Ohingaroa. The case was commenced at Blenheim, and finished at Wellington. The agreement to sell was for £IB,OOO, and £IOOO damages was also claimed for profits on the property and stock. The defence was that the contract was made with an infant and adult and that the infant could not bind himself to take land, both parties being under mistake when the contract was made that the infant could hold land. Mr. McGregor could not see how one of joint contractors could successfully sue the other parly to the contract. and gave judgment for defend ant. with costs as on a claim for £ISOO, and fifteen guineas per day for the second and third day of the trial.
