The responsibility for the loss of furniture and bedding destroyed by fire iin a railway, truck was disputed in a claim for £54 16s 6d for goods supplied by Edw,ard Abbott, Ltd., against Gerald Haycock and Etic McCoskrie in the Magistrate’s Court. It was stated that the Railway Department refused to- pay for the goods and an extra Is 6d per ton had not been paid with the freight to render the Department liable. Defendants ordered the goods from plaintiffs to be delivered to a customer. , ' Mr McKean, S.'M., said he did not think, under the circumstances, there , was any dutv on plaintiff except to hand the goods to the transport company in the ordinary manner. Plaintiff was awarded the amount claimed, with costs.
