JURY’S VERDICT APPEALED AGAINST.

ALLEGED EXCESSIVE DAMAGES. (Per Press Association.) WELLINGTON, July 17. The Appeal Court is engaged hearing an appeal against a new trial m the divorce case of Daniel Tranter-, of Christchurch, against Lucy Tranter and James I,ami), Sydney, hotelkeeper. The jury awarded £ISOO damages and counsel for co-respond-ent moved for a new trial on the ground that the damages were excessive. This was granted and Tranter has appealed. The point of the case is that it is, established law that damages must he purely 'compensatory and not punitive. .■ x Counsel said this was the first case for a great many years in the British Empire where application was made for a new trial merely on the ground of excessive damages. This is the first time the jury's estimate of damages has been interfered with.
