DRIVER ARRESTED

Within Few Hours of Magistrate’s Warning

INTOXICATION CHARGE i Within four hours of being fined £l5 and having his driving licence cancelled for a year on a charge of being intoxicated in charge of a motor vehicle, John Franklin was again arrested in Hastings yesterday, and he appeared before Mr F. C. Wilkinson, J.P., this morning on a similar charge, this time in Queen street. He was remanded to appear before the Magistrate next week. '

Shortly before mid-day yesterday the Magistrate, Mr J. Miller, S.M., when convicting Franklin, drew attention to the fact that there had then been four such convictions recorded in Hastings within the week and in issuing a warning to motorists he_said: “It is quite apparent that the infliction of heavy fines and the cancellation of drivers’ licences is not sufficient deterrent, and if the road is to be made safe for the public there is only one alternative now left the Court. That is imprisonment and it seems that the Court will be forced to that recourse to protect the public.”

When asking for the remand this morning, Senior-Sergeant G. Sivyer said that the defendant had been before the Court yesterday morning and it was considered that the present case was a matter to come before the Mogistrate to deal with.

No opposition to the application was made by Mr W. E. Bate, who represented the defendant, and he made application for bail, saying that the defendant lived at Ocean Beach and during the period of remand it was not likely that he would be in town. “This morning he signed a prohibition order,” added counsel, who asked that che amount of bail be fairly reasonable under the circumstances.

“The police have no objection to bail provided the defendant clearly understands that he must not drive a car under any circumstances, ’ ’ said the senior-sergeant. Mr Bate mentioned that the defendant had also signed a transfer of ownership of the motor vehicle to his wife, so he was relieved of all responsibility in that direction. The Court allowed bail in the sum of £5O and a surety of a like amount.
