MAREO’S APPEAL
Hope That New Trial Will Be Granted NEW EVIDENCE FOUND By Telegraph—Press Association WELLINGTON, April 21 Application for a fresh trial in the Mareo case has been made to the Gov-ernor-Gene; al-in-Couneil on the grounds of the discovery of new evidence uol previously available. Although no official statement could be obtained, it is believed favourable recommendation for a re-trial is almost certain.
When the matter was referred to the Attorney-General, the Hon. H. G. IL Mason, to-night, he stated that when an application was made for the mercy of the Crown on behalf of any person convicted of a crime, and the Governor-General-in-Council entertained doubt whether such person ought to have been convicted, he might direct a new trial at such time and before such Court as he thought proper. In the present case, Mr O'Leary, counsel tor Mareo, had made application to the Attorney-General, and submitted new evidence which was not available nt the previous trial.
The Governor-General is out of town nt present, but the application would be placed before a meeting of the Executive Council as soon as it conveniently could bo arranged after his return to Wellington.
