BREACH OF PROMISE

—-— • '—II * Woman Awarded £25 Damages

By Telegraph—Press Association. CHRISTCHURCH, June JB.

Damages amounting to £25 wore awarded by Mr Justice Northcroft, in the Supreme Court to-day in the case in which the plaintiff, Elsie Preston, of Bluff, claimed £25 special damages and £5OO general damages from Stephen Allen Hagerty, picture show manager, Now Brighton, for breach of promise. For plaintiff it was alleged that plaintiff and defendant agreed to marry on September 15, 1934. Tho defendant had not carried out tho agreement. The defence was a denial of any pro-

mise to marry. His Honour held that there had been an agreement, but it had been broken off for a proper reason—that the man had lost his affection for the woman. There were no sordid or sinister conditions to justify exemplary damages. He assessed the damages at £25, with costs on the Magistrate’s Court scale.
