Failure to Make Deduction
CONTRACT SHEARER FINED
On the information of Mr. E. A. Wood, inspector of awards, James Nuku was charged before Mr. J. Miller, 8.M., at the Hastings Magistrate’s Court this morning with failing to deduct or cause to be deducted from wages to employees the emergency unemployment tax. Mr. W. E. Bate appeared on behalf of Nuku, who entered a plea of guilty. Mr. Wood said that the defendant wa» a contract shearer. At the end of the last season he failed to deduct the unemployment tax when making payment of wages. The wages amounted to £957 15/4 and the amouut that should have been deducted as tax was £2B 5/9. Mr. Bate said that Nuku had onlyjust taken up contract shearing. In the first payment Nuku received the tax payable was deducted from the cheque paid to him. In the second payment that he received Nuku thought that the tax had been again deducted, as was the case when he received his first cheque. Nuku was now on relief and would not bo in n position to pay any portion of the tax until the next shearing season. Counsel submitted that it was not a case in which Nuku had attempted to deceive the department, it being evident that he did not make proper enquiries. His Worship said that although there mav have been a misunderstanding on the part of Ntrk'i. there had also been carelessness which could not be overlooked. Nuku was convicted and fined £2. with a further line of £2B 5/9.
