Judgment by consent was entered by the Magistrate, at Auckland to-day m the claim by W. H. Le Sueur, civil servant. for £l2 10/- against Harold Bradley Brownrigg. The Statement of Claim asserted that the defendant and his agents represented to the plaintiff that there existed a company known as “Overseas Passages, Ltd.,’’ which had available passages from Auckland to Southampton on a ship leaving about the middle of February. The single fares ranged from £25 to £3O and wero free of exchange. Plaintiff paid £l2 10/- as a deposit for himself, his wife and child. Counsel for the plaintiff said that tho claim was made against Brownrigg because the alleged company did not exist. The whole thing appeared to be an organised swindle. Counsel for the defendant, who did not appear, consented to judgment for £5. but said he was instructed to repudiate the suggestion of fraud. The representations were not made by the defendant but bv another person without the defendant’s knowledge or authority. Tire Magistrate gave judgment for £l2 10.-, plus £6 8 2 costs. —Press Assn.
