Yqpr client has been convicted ot attempted murder you know,” said Mr Justice Smith to counsel! making a plea on behalf of Albert Best, brought up for sentence for negligent driving and causing death. Counsel replied that the case referred to by his Ilonour was deliberate and the present offence could not be similarly classed The man who had been killed was a friend of the accused and was a passenger in his van at the time of the accident In view of the fact that the offence was not deliberate counsel asked his Honour to deal leniently with the accused. His Honour, (to accused): You have been founj guilty of driving in a reckless manner and causing death. It appears that you were reckless and under the influence of liquor. | acquit you of any deliberate intention to kill your friend but the manner in which yon ran into the lorry showed utter recklessness and disregard of danger. Tn view of the circumstances I would not admit yon to probation and in view of your record I could not. You will be sentenced to a period of reformative detention not exceeding two years.”
