DEFENCE MOTION DISMISSED. Honolulu, Jan. 30. The Court dismissed the defence motion to dismiss the indictment ns “without merit.” Judge Cristy demanded that the defence counsel reveal the sources of their information regarding the Grand Jury’s proceedings, which are secret by law. Counsel refused, whereupon the judge warned them that they would be liable for contempt of court. NEXT STEP TO-DAY The Fortesque defendants were released to navy custody about noon. After the Secretary of the Navy had approved arrangements for admission to bail, they spent the night in the police station, where they were made as comfortable as possible. Then, after the court proceedings, left for the navy yard at Pearl Harbour. The next step is entering of a plea on the charge of second degree murder on Monday.
