FORTESQUE TRIAL
GRAND JURY’S REPORT NOT ACCEPTED. JUDGE ADMONISHES JURORS. (United Press Association—By CableCopyrigbt.) (Received 27, 11.20 a.m.) Honolulu, Jan. 26. As the Grand Jury reassembled, Judge Christy revealed that that body had to-day presented a report which the judge refused to accept. The judge issued new instructions admonishing the Grand jurors to put aside personal prejudice which had hitherto interfered in the voting regarding the indictment in the Fortesque trial. JAPANESE LYNCHED. CITY IN PANDEMONIUM. Auckland, Jan. 26. Further details of the lynching sensation at Honolulu on January 8, when Joseph Kahahawai, a Japanese youth who was awaiting trial for assault on the wife of an American naval officer, was kidnapped and shot, are contained in Honolulu newspapers brought to Auckland by the Niagara yesterday. Five native men, one of whom was Kahahawai, were accused of criminal assault upon Mrs Thalia Massie, wife of Lieutenant Massie, in September last. They were brought to trial in November, and after the jury had failed to reach a verdict they were held for a re-trial and released on bail, with a provision that they should report daily to the police. The first sensation occurred on December 12. when another of the accused. Horace Ida, was kidnapped by a score of unidentified men. who carried him off in a waiting motor-car. He was compelled to take off his shirt ano was beaten with belts. He was left partly unconscious some distance from the road, bnt made his way back to the road later and was picked up by passing motorists. He was unable to identify any of the men brought before him for inspection, but stated that a sailor yeas the ringleader** the group.
