NAPIER MAGISTRATE’S COURT

TO-DAY’S PROCEEDINGS.

John Kavanagh (Mr J. J. Molonev) pleaded guilty to committing a certain objectionable act on the Marine Parade last Saturday. The offence was committed in the presence of women. Counsel said that the accused, who was married, with eight children, was helplessly drunk at the time and did not remember what he did. His Worship took a very serious view of the case and sentenced the accused to three months’ imprisonment. Francis Andrew McNamara was charged with a breach (his third this year) of a prohibition order. “He is qualifying very fast for a trip to the Island,” commented His Worship in fining the defendant £4 with costs 10s.

James Wilson Sparks was fined £1 with costs 10s for his first breach of a prohibition order William Plowman (Mr E. J. W. Hallett) pleaded gunty to being under the influence of liquor whilst in charge of a motor vehicle. Sergt. Hodgson stated that on January 31 at Clive there was an accident, and on investigation the police found that the defendant had had drink. He was returning from a boxing match in Hastings Counsel said that the accident was caused by anotb'? car running into the back of the defendant’s car, and that the defendant’s condition had nothing to do with the mishap. The defendant was wellknown in Napier, and had not been in trouble before. “My duty to the public demands that I take a serious view of cases of this type,” said His Worship in fining the defendant £lO with costs £1 6s, and also suspending his license tor six months. Leslie Edwards, James Manahi and James Ransfield were each fined £1 with costs 10s. for riding bicycles at night without lights attached. Andrew Stewart was fined 10s with eosts 10s for allowing his car to stand more than 12 inches from the kerb. On a similar charge, Frederick Edward Bowen was convicted and discharged. On the information of the borough inspector (Mr A. M. Oliver). Robert Boyd was convicted and fined 10s, with costs 10s, for permitting a car to be stationary in Tennyson street in such a position as to cause an unnecessary obstruction. On the information of the Borough Inspector (Mr A. M. Oliver), Frcdcr- , iek Lionel Bushby and Harry Ellis ♦ were each fined £1 with costs £1 0s 6d for leaving a car more than 12 inches from the kerbing. John McKenzie (Mr J. J. Moloney) charged with committing a serious assault, pleaded not guilty. After hearing the evidence the charge was reduced to one of common assault, on which count he was convicted and sen fenced to 14 days’ imprisonment.
