MAGISTRATE SCORES COUNSEL LOSES A FEE A smile was raised in the Napier Magistrate Court this morning when His Worship, Mr. A. M. Mowlem, S.M., scored a point at the expense of Mr. H. B. Lusk, who was representing tho Napier Borough Council. Several charges relating to ihe registration of dogs were brought forward, but Mr. Lusk asked that they bo withdrawn, as the defendants had taken tho warning and registered their dogs. “Some day I might ask how it comes about that tho Court is used to compel these people to egister their dogs,” remarked His Worship. “What would happen if I refused to allow the cases to be withdrawn?” Mr. Lusk: I would offer no evidence. “Oh, then I would have to dismiss tho information? You have me both ways,” acknowledged His Worship. Later on, however, the ease of one dog fancier was heard and a conviction was entered. Mr. Lusk asked lor solicitor’s fee (.10/6). “In view of what was mentioned before, I don’t think I will allow it,” remarked His Worship, amid smiles. “Very well, Sir,” replied Mr. Lusk with a graceful acknowledgement of defeat.
