IN THE MATTER of a Bill intituled “ The Napier Harbour Board Amendment and Endowment Imi proveiuent Act 1912.” ■fcTOTICE IS HEREBY GIVEN that it A' is the intention of the Napier Harbour Board (hereinafter called “the Board”) during the present Session of the General Assemb’.- of New Zealand to pro.not. 1 tiie passing of a Bill to enable the Board — - (a) To fill up and reclaim the whole or sutv, or any pait or respective parts' of certain areas of laud (being Harbour Reserves) to wit, FIRSTLY 1181 acres 2 roods W:ore or less, part of T? WhareO Mararimi Block, and 13 acres, more or less, part of the Ahuriri Lagoon, as the said areas are described in the First Schedule to. the said proposed Act SECONDLY 513 acres, more or less, being part of the Ahuriri Lagoon, situate to the eastward of the Napier-Taradale road, as the said area is described in the Second Schedule to the said proposed Act. AND THIRDLY portions of the Port Ahuriri Lagoon, situate at Port Ahuriri, containing respectively 23 acres, more or less, 1 acres 3 roods, more or less, and 38 acres, more or less ,as the said areas are described in the 'Third Schedule to the said proposed Act. (With respect to the 'ands described in the said First and Second Sched tiles to the .said proposed Act, it is to be noted that the proposed Act is confirmatory of existing Statutes giving the Board power to fill up and reclaim such lands). (b) In addition to and not by way of substitution for the power to borrow £13,000 contained in “ 'The Napier Harbour Board Amendment and Endowment Act 1899 ” to borrow, subject to the provisions of “ The Harbours Act 1908 ” and the amendments thereof, and of the said proposed Act, upon the security of the areas of land described in the said First, Second, and Third Schedules to the said proposed Act, or any of them, or any part or parts thereof respectively, and of the present and future rents thereof (but subject to all prior charges thereon), any sum or sums of money not exceeding in the whole £30,000 at any rate of interest not exceeding £5 per tentuni per annum payable halfyearly, to be applied in payment to the present lessees of the land described in the said First Schedule to the said proposed Act on the surrender of their Lease, and as part of the consideration for such surrender the -sum of £4OOO, and in and about filling up and reclaiming the said areas so proposed to be filled up and reclaimed (including the purchase of the necessary machinery and plant), or wholly for such last mentioned object. With ' power for the Board out of the loan moneys to recoup its general revenue or any other source the said sum of | £4OOO, or any other moneys which may have been expended by the Board out of'such general revenue or other source in and about the reclamation and improvement works, or the purchase of’machinery and plant, by | the said proposed Act authorised, j All moneys proposed to be raised under the authority of the said proposed Act are to be raised in the man- i ner prescribed by " The Local Bodies | Loans Act 1903 ” and the amendments ! thereof (save where,, inconsistent with | the said proposed Act), and no such moneys can be raised unless sanctioned by a Poll of the ratepayers of the Napier Harbour Rating District taken in manner prescribed by the last mentioned Acts and the said proposed Act. The Board is to provide for repayment of the moneys authorised to be: raised by setting apart as a Sitiking' Fund a sum equal to One Pound pm : centum per annum c.n the aggregate; amount of debentures for the time being ; issued under the said proposed Act.
