In the case of Stubbs v. the Ne v Zealand Coal and Oil CempanN. ; n which the plaintiff claimed compen sation for injuries sustained bi the company’s mine, the plaintiff claimed that disease of osteoarthritis in the knee from which lie suffered, was aggravated by a fall of coal. Judgment was given for the defendants. In the case in which the pare ns of James Campbell, who was fatal y injured in the YVestport Coal Com pany’s mine last March. claimed compensation from the company, the court held that the plaintiffs were partial defendants, and awarded them £69 with costs. Witnesses’ expenses were not allowed.
