JUDGMENT GIVEN FOR THE DEFENDANTS.

The Deputy Registrar of the Supreme (.'curt, Air. At. Trimble, delivered the reserved judgment this morning at the Napier Court of the Chief justice (Sir Robert, Stout) in the ease Henry John Holder v. the Phoenix Assurance Company. This case was a claim for £3OO for the loss sustained by the plaintiff through the destruction by fire of his motor car. The motor was being driven in the suburba of Napier one night when something happened to the steering gecr. the result being that the car over the bank and fe'l into seine water alongside the road. Benzine flowed from the tank and floated on top of the water and the gar. arising from it was ignited by the Limps on the motor ear, withthe result that the car was destroyed. His Honour contended that the immediate real and proximate cause -f the outbreak was a light in the ear. Judgment was given for the defendants with costs according to ".(•lie, witness-ci; expenses. and disburst merits to be fixed by (lie Regisi rar.
