SMITH v. HOBEN. Wellington. July 24. This is an appeal from the judgment of Sir Robert ytout. delivered on. an oringinating summons to determine the construction of a bailment entered into by VUlliam Henry Smith .of Marton, owner of the “ Manawatu Daily Times ” newspaper, and Ernest Denis Hoben, under which Smith gransed to Hoben the l ight to print and publish the said newspaper for the term of six years. The main question in dispute is the meaning of the term as used i". the bailment, “net realised profits.” The rens reserved is one half of the neft rea'ieed profits, ascertained halfyearly. There is also a provision that Hoben shall be entitled to drav. £lO a week as against ariiicipMcd profits, and the question is whether this sum is to be deduct-
