M ellington, July 10. In the Appeal Court. Judges Williams, Denniston. Sim and Edwards sat to hear the case originating, in a summons moved into Court Lv agreement between Mr. G. P. nelly, of Hawke’s Bay and the Commissioner of Taxes. The questions lor the court s consideration arise in connection with the interpretation of section 56 of the Land ami Income Assessment Act of loos By her will the testatrix devised to' her husband (plaintiff) all her interest in the Waimarama blocksubject to certain conditions, and these conditions are unfulfilled. The plaintiffs present occupation is by agreement with the trustees until they should require possession thereof for the purposes of sale, subject to payment of interest on certain mortgage moneys secured on the properties. Messrs. H. D. Bell and Lewis appeared for the plaintiff, and the Solicitor-General for the Commissioner.
