Wellington, April 26. An unusual case was before Mr. Just ice Cooper to-day. The original action was by Mabel CarringI ton Hutchison, one of the daughters of the late William Booth, of Carterton, against the Public, Trustee, as executor, to have ac-1 counts taken on the basis of alle- ! gat ions of negligence against the Public Trustee, particularly in the I sawmilling business. • The Judge held that the losses i were mainly through circumstances : ever which defendant had no coni trol. Plaintiff had failetl to estabJ ’ish any breach by defendant. To day the defendant moved for

judgment with costs as between : solicitor and client. Mr. Petherick. who received judgment for plaintiff, though Mr. j Geo. Hutchinson was the solicitor ;at the hearing, consented to the I action being dismissed, but regist- [ ered an application regarding costs. The action was dismissed with costs as between party and partv. The Judge said plaintiff had brought the action upon his solicitor’s advice, which he did not I doubt was honestly given, although in his view it was erroneous.
