Williams, £2 6s 6(1. costs 16s; G. Barton v. J. T, Davy. £l, Os 9«l. costs 9s; French and Co. v.. D. Ciirmichncl, £1 Us 2d; costs 15s; sum’ v. ,1. Mutheson, £lO 3s 9(1, costs 35s 6d; gnine v. A, G. Lewis, £2 Is. costs 10s; same v. J. Houlahan, £2 13s, costs 10s; same v. John Blair. 15s 6d; costs ss; same A. Cruder), £2 10h sd, costs 14s. John Green, of Pongaroa. was charged, on the information of J. Louden. Weber county overseer, with committing a breach of the county by-laws by driving a dray on the Weber - Wimblodon-road, tin tyres of wheels were only four inches wide. A line of 50s was imposed, with costs 7s. and solicitor’s fee £1 Is. Mr Lloyd appeared for the council and Mr Patterson for the defendant. Mark Green. Fred Simpson, and Harry Anderson were charged with permitting horses to trespass on the railway line in the vicinity of the Tamaki bridge on February 28th. The defendants pleaded guilty. Sergeant Cmickshank prosecuted, and said defendants had riot attempted to conceal anything in connection with the case, and had lost three horses valued at £45. The bench imposed a fine of 20s, with 7s ’costs, in each case, saying they had no intention to create a precedent, as the offence was a very grave one; indeed, one by which serious loss of life might be brought about. K. H. Evans, a ledgerkeeper in the Bank of New South Wales, sued Henry Dance for £lO alleged to have been ’ overpaid to the defendant by plaintiff on December 23rd last, whilst the latter was acting as teller of the hank. Mr Lloyd appeared for the plaintiff and Mr J. C. Westall, of Napier, for the defendant. This case took up the greater part of the day. For the plaintiff it was sought to establish that the defendant cashed two cheques on the date mentioned, amounting to £54 Us. and according to the case for the plaintiff, it was shown by the usual pencil memorandum on the back of one of the cheques that the amount paid out was £64 Us, less 2s exchange. At the end of the day the shortage was discovered, and after a search it was traced to the cheques in question. The plaintiff rodo to Makotuku. and interviewed defendant, who denied being overpaid. The plaintiff’s evidence as to finding the error was substantiated by Mr A. Paul, manager of the bank. After examining several witnesses on both sides counsel addressed the court. The bench retired lo consider their verdict, and on returning announced that the plaintiff would bo non-suited, each party to pay his own costs.
