HENDERSON AND NAPIER HARBOR BOARD.

The following is the correspondence to which reference was made yesterday in our report of the Harbor Board's meeting :— Napier, 4th March, 1879. Dear Sir,— l have to inform you that active litigation in Henderson v. Harbor Board recommences on the 18th inst. at Christchurch unless a settlement is previously arrived at. . While not at all inclined to prejudice my client's claim or case in the mind of : the board by making any undue applica- ■ ! tion or advance, yet I feel that it it is' my duty to inform you that my client, taking into consideration the fact that the board is a public body, is still prepared, as he : always has been, to meet the board in an amicable spirit. You will observe from my letters to the late board, that previous to any action being taken every effort was made by me on his behalf to obtain a settlement of his claim by arbitration or otherwise. These letters were not received favorably » by the board, and it was only with ex- 4 treme reluctance that my client was com- , polled to commence a lawsuit which was certain to be of a most expensive nature. I need not inform you that the costs will be very seriously increased if proceedings are not stayed before it is too late to prevent counsel proceeding to Christchurch on the 18th, for further argument as to whether or not there should be a new trial. As solicitor to the plaintiff, I have to request that all communications in regard" to the settlement of the suit, or satisfaction of the judgment already obtained, be for-* warded through me. I have to make this request because I am informed that some communication has been received by the board which has not been sent by me, claiming the proceeds of the Christchurch judgment on behalf of Mr Henderson or the trustees in Mr Henderson's estate.
