; IN BANKRUPTCY. ! Monday, June 18. J (Before His Honor Mr Justice Richmond.) 1 His Honor took his seat on the Bench at 1 10 o'clock. 3 RE EDWARD THOMAS. ' Mr Rees for the bankrupt applied for 1 the order of discharge. The case, he said, * like the majority of those before the Court that day, was a small one. There were no opposing creditors, and all the steps ' required by the Act to be taken had been taken. ' The Registrar handed in his report, from which it appeared that no creditor 1 had attended the meetings, that no 1 creditor had proved in the estate, and that 1 the assets were nil. His Honor expressed his gratification ! at having reports in these cases from the ' ' Registrar ;it was a practice which he had 1 had occasion to regret was not pursued in Wellington. He noticed that in the 5 case now before the Court there were ' one or two creditors in Auckland, and as far as they were concerned the notice of the present application was short. Still, as they had not attended a meeting, though they might have done so by proxy, 3 and had not proved in the estate, it did not seem as if they had anything to ad--1 vance against the passing of the bankrupt. L His Honor did not, besides, think that | any of the creditors would be benefited by holding over the discharge of the bankrupt. The matter could at any time be ' ripped up if it was not honajide, and there ' was no reason to suppose it was not so. Order granted. RE HENDERSON GORDON. [ Mr Rees applied for the order of discharge in this case. The report of the Registrar was similar to that in the previous case. His Honor remarked that it was curious that in despite of all legislation on the subject the course of business in bankruptcy still ran smoothly— no creditors present at meetings, no proofs of debt, no assets, no opposition, order granted — it might almost be done by machinery. The order as applied for by Mr Rees was granted. RE CHARLES MACINTOSH ROBERTSON. Mr Rees also applied for the order of discharge in this case. Order granted. RE FREDERICK JONES. Mr Rees applied for the order of discharge. The Registrar stated that one creditor, Mr Scarfe, had proved in the estate. Mr Scarfe was called, but he did not appear. Order of discharge granted. Mr Rees applied for the costs of the bankrupt's solicitor up to the time of adjudication. It was ordered that the costs be taxed up to adjudication, and allowed out of the amount in the hands of the trustee. RE FRANCIS EMANUEL SAUNDERS. Mr. Lascelles applied for the order of discharge. The bankrupt, now a civil engineer, had contracted the debts in his schedule in carrying on business as a baker. Order granted. RE JOHN HOWELL. Mr Lascelles applied for the order of discharge. The Registrar reported that five creditors had proved in the estate. He also stated that witli respect to the equity of redemption, mentioned in the bankrupt's statement, he (the Registrar) had made enquiries, and had ascertained that if put up to auction it would not fetch the £100 for which the property was mortgaged. The order of discharge was granted. RE W. H. SELLARS. Mr Lascelles applied for the order of discharge. The Kegistrar stated that there was an express van belonging to the estate, but there was a lien on it to the extent of £7. There were no proofs of debts, and no opposition. Order of discharge granted, and also that the costs of the bankrupt's solicitor be paid out of the estate up to adjudication. ■RE RICHARD JEFFARES. Mr Wilson applied, on behalf of creditors in this estate, that the claim of Walter Caldwell to rank as a creditor in the estate be expunged on the ground of irregularity. The proof, he said, was founded on a judgment obtained after adjudication. The debtor was adjudicated a bankrupt on the Bth of June, 1875, and the judgment was signed in July, 1875. Caldwell had been summoned to attend the present sitting of the Court, and had he attended he (Mr Wilson) would have examined him and have asked the Court
