On Tuesday the court was occupied with the case, Thomas v Mux.v and McLean. The jury consisted of Messrs. Newton, Seed, Sim, and Slater. The facts were very simple. The defendants shipped a number of sheep per Sea Serpent, and, iti driving them down, they got mixed with a number of sheep running on the Island, the proper- ' ty of the plaintiff. Mr. McLean promised the plaintiff, in consequence, that should ' any of his sheep be on board, they should I either be paid for or replaced. The plaintiff, on mustering his sheep, found 29 deficient. For the defence it was contended that so many strange sheep could not have been shipped, — that they might have been ' destroyed by dogs, and from other causes. 1 But the defendants failed to prove how 1 many sheep were taken on board or how many died on the passage. Verdict for ' plaintiff, amount claimed. \ Carter v. FitzGerald. — This was an ' action to recover £100, damages alleged to have been sustained by the plaintiff, in consequence of certain goods held in charge f by him not having been forwarded into the I interior with due promptitude. The jury, * which consisted of Messrs. Newton, Blair, ■ Seed, and Winsor, after a few minutes' de- ■ liberation, returned a verdict for plaintiff of £5. The court then adjonrned till Thursday, when some unimportant business was transacted, and the court adjourned till next sitting.
