RE-TRIAL ORDERED

JURY UNABLE TO AGREE. CASE AT NEW PLYMOUTH. At the New Plymouth Supreme Court yesterday the jury, after a retirement of live and a-half hours, disagreed in the case of Stanley Cross, charged with indecent assault on a nine-year-old-girl at- Marsland Hill, New Plymouth, on January 31. The case opened before Mr Justice Blair on Tuesday. The jury after retiring at 11.50 a.m. yesterday returned, unable to agree, at 5.15 p.m. His Honour said it was essential, since the prisoner was not on bail, to hold the retrial as soon as possible and he mad© the fixture for the re-hearing early next week. The defence in the case turned on the questions of identification and alibi. The accused was represented by Mr H. St. L. Reeves and Mr R. H. Quilliam appeared for the Crown.
