Despite the resfusal of the Pennslyvania grand jury to indict Mr Mellon for alleged tax evasion, the Department of Internal Revenue to-dav filed a brief with the Board of Tax Appeals accusing Mr Mellon, while secretary of the Treasury in 1931, of “scheming” to evade taxes aggregating 3,075,000 dollars. It is alleged he illegally reduced his taxable income by fictitious securities, sales and other devices. Mr Mellon imediatelv denied the validity of the brief and reiterated the charge that he was subject to political persecution by the in'esent administration. Ilr Mellon, when the jury found no lull, announced that instead of having evaded the payment of 710.000 dollars income tax in 1931 as charged he actually overpaid and would now seek a refund. Mr Mellon, reputed to be one of the richest men in America, was until a few months ago United States Ambassador to Britain.
