■FACTORY MANAGER’|S DEATH NOT A MANUAtL 'WORKER Tn a reserved judgment, the 'Court o.f ‘Appeal at Wellington yesterday decided a case in which the main question at issue was whether a person who, while ‘holding the position of manager of a butter had a large part of his duties in helping those employed under him in manual work. The court decided that this rwas not possible, and therefore dismissed an appeal ‘brought by the wife of James iSmillio, a factory manager at Bulls, who died as a result of an accident in the factory. u For the purpose of compensation claims the definition of a worker does not include any person- employed otherwise than by way of manual labour. The argument used on beh'alf of the widow was that she was entitled to compensation through her husband’s death for the reason that although manager of the factory, he had been, in common with most others in a similar position, a manual worker. Holding that the substantial nature of the employment of deceased had been not the manual labour that ho performed, but the management and control of the factory, the Chief Justice (ISir Michael Myers), Mr Justice Herdman, Mr Justice MacGregor, Mr Justice Blair, and Mr Justice Kennedy dismissed the appeal.
