f» the New Plymouth Court on Ilumsday a claim for £163 14s in relation to a car purchased and returned for resale was made by Mrs. Evelyn Cottrell, Okaiawa, formerly of Warea, against E. Cawthray before Mr. R. W. Tate. 5.M.,. At the conclusion of the ease tor the plaintiff a non-suit point was raised and the magistrate indicated lie would consider this before asking! the defendant to go on with hi.s case. Mr. C. E. Monaghan appeared for the plaintiff and Mr. A. A. Bennett for the defendant. It was stated in the evidence that Mrs. Cottrell purchased a car from Mr. Cawthray for £314, paying a deposit of £IOO and trading in another car for £74, the balance being given in two promissory notes. It was alleged that a guarantee had been given by the vendor, but this was not admitted by the defence. It wa:s also submitted that the car had been returned and that therefore there was! no sale.
The magistrate pointed out that it was necessary to prove a sale. He said he would consider the non-suit point before calling on the other side.
