STRANGE LEGAL CASE. Reference to a strange case that has vitally affected the law of negligence was made by Judge Crawford, at the County Court at Edmonton, England, recently. A century ago, the judge stated, someone tied the legs of an ass and left it lying on the road at night. A horse and van came along and ran orer the ass, causing fatal injury. .The owner recovered (damages, not irom the person who tied up the animal, but from the driver of the horse and van, for he was held to be guilty of negligence. The decision in that case, declared the judge, still remained the law. The anecdote was told in the course of the hearing of a claim against the North Metropolitan Electric I’ower Supply Company for damages to a ear in a collision which, he said, was caused by the company leaving ruts m the road. , . The jury found that plaintiff was guilty of negligence in not observing the ruts and judgment was given for the eompany.
