A WATERSIDER’S CLAIM.
ACTION AGAINST SHIPPING COMPANY. (Bv Telegraph —Press Association.) WELLINGTON, Aug. 19. A watensider named: Joseph. O’Brien its pursuing a oil aim in the Supremo Court before his Honour, Mr Justice Smith, against the Diinediin-Wanganuj Shipping Co., arising from an accident on the steamer Holmdale, the plaintiff alleging permanent injury, in regal’d to which mediieail evidence was given, assessing the injury at two-thirds ol plaintiff’s earning capability. The plaintiff was struck by cargo falling -out of a sling, and negligence is alleged on the part of the defendant in allowing cargo- to 'be loaded oil the principle of block stowing, and in failing to provide- fore and' aft space of at least eleven feet- between the fore and -aift ends of the- hatch coamings and the nearest cross beam. Itis also oontended. that the- omission of the hatchman to stop joint until the sling had ceased spinning contributed to the accident. The claim is for £ISOO.
The defence is that the breaking up of the isling was a pure accident and defendant himself was negligent in failing to step clear after making the sling, also in preparing the sling and in other -ways.
