WRIGHT .MORGAN CASE. (By Telegraph—Press Association.) WELLINGTON, July 16. 111 the Appeal Court this morning judgment was given in the Wright versus Morgan case, which was heard on July 4. Delivering his judgment, Air Justice Smith said the sole question in the appeal is as to the basis upon which Douglas Wright should pay 'ail occupation rent for use of "two estates, Surrey Hills and Windermere. The judge in the court below found that the occupation rent should be based on the Government valuations of the land from time to time. In doing so he exercised his'discretion as to what was practically just in the circumstances. AVe agree with that decision and the appeal must be dismissed. Subsequent experience made it clear that for the year 1921 even the Government valuations were excessive and Air Donnelly has offered tc> reduce the Government valuation for that year by the sum of £18,500. The judgment of the court below will be varied accordingly and costs allowed to respondents on the highest scale as from a distance.
