Kerr, aged 14, was awarded £ll2O damages against David Baird, contractor, for injuries sustained through being knocked down by a motor lorry, which passed over his leg. The medical evidence showed that the hoy had undergone four operations, and a foot might require amputation. The question at issue was whether the defendant, in passing, had allowed the boy. who was cycling, sufficient- room. Mr. Justice Sim said that, as the road was wide enough, there was no need for defendant to he so far over on iiis left side when passing. No driver was entitled to sail too close to the wind, and he should have provided a proper margin of safety.
