This last litigation arises out of a dispute as to the validity of the power of attorney given by one of the bene liciaiies, by which a deed of compromise was drawn up and (acted upon by the trustees in the estate of the late E J. Wright and the Bank of New Zealand. Those negotiations, which took place practically within the walls of the Court, were not the matter to which lie had referred, lie had referred to obstruction generally in the earlier attempts at a settlement. Mr Justice Adams said that the court did not wish to discuss the responsibility for the breakdown of the settlement. * When the question was raised as to whether the Hoii. Mr. Noswaithy" one oil tlm trustees, should be called, Sir John Findlay said he wais prepared to admit that Mr Noisworthy had acted piudently and with sound judgment, and had acted impartially as between the beneficiaries in the administration or the estate.
